I. Preamble

The SCOP Algues Provence Production is called in the general sales conditions "SCOP APP".

The SCOP APP specifies that its online sales are exclusively reserved for consumers, non-professional buyers, agreeing to fill in the mandatory fields presented at the time of registration and having a delivery address located in one of the areas served by La SCOP APP.

These general conditions of sale and the specific conditions of sale specific to each of the articles offered on the site www.spirulinedusoleil.fr govern alone, without restriction or reservation, the relations between the SCOP APP cooperative production company with limited liability with capital of € 4,000.00, whose head office is in Verquières (13670), 105 Route nationale 7, registered in the Tarascon Trade and Companies Register under number 529 162 562, identified under the intra-community VAT number FR54529162562 and its clients of the Site , with the exception of all other conditions and, in particular, those applicable for sales in stores or through other distribution and marketing channels.

II. Acceptance of the general and specific conditions of sale

Any confirmation by the customer of an order entered on the Site implies full acceptance of these general conditions of sale of the SCOP APP and the specific conditions of his order (items ordered as presented on the Site within the limit any quantities mentioned, name, price, components, etc.). It is specified that the customer has, before this confirmation, a mechanism allowing him to correct or modify his choices. This mechanism is accessible at each stage of the order entry process. The modifications of the general conditions of sale are opposable to the customers of the Site as of their setting on line and cannot apply to the transactions concluded previously. SCOP APP therefore invites customers to carefully re-read the general conditions of sale in force with each new order, said conditions being available online at the Site address and available on request at Spirulinedusoleil@orange.fr

III. Products

Each item offered on the Site is subject to a summary presentation indicating its name, quantity and price. This information is included in the product sheet detailing the description and composition of the product. The photographs of the products are not contractual.

IV. Period of validity of the offer

Our offers are only valid during the online presentation period and are within the limits of available stocks, the indications on the availability of products being provided at the time of placing the order. In case of unavailability of the product after placing your order, we will contact you by phone or e-mail as soon as possible to inform you and agree with you:
- to delay the delivery while awaiting the restocking of this product, when possible,
- cancel your order and reimburse you for any price paid within thirty days of its payment.

V. Username and password

During the first order, a user name and password are chosen by the customer. The user name and password are proof of the customer's identity and bind him to any order placed through them. They have the value of an electronic signature within the meaning of the law of March 13, 2000. The customer is solely responsible for his username and password and will bear alone the consequences that could result from any use by third parties who are aware of those -this, unless it demonstrates that the knowledge of this identifier and of this password results from a fault of SCOP APP. In case of forgetting his password or his identifier or in case of fear that a third party may have known about it, the client has a function on the Site allowing him to retrieve his identifier and choose a new one password.

VI. Formation of the contract: procedure and proof

6.1 Registration and confirmation of the order

Any order entry is simultaneously the subject of a summary before the customer is invited to confirm his order by indicating his choices as for the delivery address and the means of payment. The customer is then invited to confirm his order. As of this operation, the order is registered automatically and becomes firm and final only under the following reservations. Any order with choice of payment by bank card (PAYPAL) is only considered final when the payment centers concerned have given their agreement. In case of refusal of said centers, the order is automatically canceled and the customer notified by a message on the screen by the payment center. Any order with choice of payment by check is only considered final when the payment is received and actually cashed by SCOP APP

6.2 Confirmation of receipt of the order

SCOP APP confirms to the customer the receipt of his order. This confirmation is communicated to the customer by email summarizing the products ordered, the delivery address, the chosen means of payment (online or by check) and indicating an order number. The information stated by the customer when placing the order commits it: in the event of a customer error in the wording of his contact details or those of the place of delivery, in particular his name, first name, address, telephone number, email address, door code, floor resulting in loss of products, the customer remains responsible for the payment of lost products and no compensation or reimbursement can take place.

6.3 Evidence

The automatic registration systems of the Site are considered to be proof of the nature, content and date of both the customer's order, the confirmation of receipt of the order by SCOP APP and any email exchanged between SCOP APP and the client. The information relating to any operation carried out using the identifier will be stored and archived by SCOP APP and will serve as proof in the event of a dispute with the customer in accordance with the law of March 13, 2000 on signature and electronic proof. They will have probative force in the event of a dispute between the parties and will be kept by SCOP APP for all the time necessary with regard to the legal rules of prescription.

VII. Price

The prices on the Site are expressed in euros and take into account the value added tax on the day of the order. Any change in the applicable value added tax rate will be automatically reflected in the price of products on the Site. Prices do not include delivery costs, the amounts of which on the day of the order are indicated on the Site and at the latest before the customer sends a seized order. The total price including tax indicated in the confirmation of the order is the total price of the order entered expressed all taxes included including the price of the products and the transport costs.

The customer agrees to pay the sale price in effect at the time of entering his order, that is to say that indicated on the site.
The payment of the order is payable on the day of the actual order.

The SCOP APP reserves the right to modify its prices at any time.

VIII. Payment

You choose when entering your order to opt for a payment by credit card (PAYPAL), or by check. In the event that you choose a payment by bank card, you are then redirected to the secure site guaranteeing the preservation of the confidentiality of the card numbers by protection and cryptology procedures. Payments by check, made payable to SCOP APP, must be sent, together with a printout of the order confirmation email (mentioning the order number) to the following address:


The SCOP APP reserves the right to wait for the actual cashing of checks in its bank account before the shipment of the goods. This operation can result in a delivery time of up to 15 days.

Payment in 2 or 3 times without fees

From the second order and with a payment by check drawn on a bank in France, the SCOP APP sets up the possibility of payment in 2 or 3 times:

- From € 60, the customer sends the SCOP APP 2 checks for the same amount corresponding to the total of the order. The SCOP APP will cash the 1st check upon receipt and the second at 30 days.
- from 110 €, the customer sends 3 checks of the same amount to the SCOP APP corresponding to the total of the order.
SCOP APP will cash the 1st check upon receipt, the second at 30 days and the third at 60 days.

The SCOP APP reserves the right to suspend this payment facility if any doubt or inconsistency could arise on the following points:
· Customer's name and address
·         Telephone number
·         Email address
· Bank details of checks
· Previous problem with the client

The SCOP APP will inform the customer within 8 days.

IX. Delivery

9.1 General

The shipment of the order can only be made after receipt of payment of the full price and shipping costs. All events considered by case law as force majeure, which would tend to prevent or make the performance of supply exorbitant, constitute, by express agreement, a cause for suspension or termination of the obligations of SCOP APP, without compensation for the benefit of the client if the event extends beyond a period of fifteen (15) days. SCOP APP will inform the customer by any appropriate means of the existence of such an event in order to allow the latter to disengage from his order by means of a simple reply by mail.

In case of delay in shipment, an email will be sent to you to inform you of a possible consequence on the delivery deadline which has been indicated to you.
In any event, in accordance with legal provisions, in the event of a delay in delivery of more than 7 days, you have the possibility of canceling your order within 60 working days.

9.2 Delivery costs

The delivery costs are calculated automatically during the order and appear on the page indicating the prices of the order before the final validation of it.

9.3 Delivery times

SCOP APP undertakes to do everything in order to deliver the order in the shortest possible time, upon receipt of the order form and of the payment. Delivery will be made by post by COLISSIMO tracking mail to the address indicated by the buyer on the order form. The customer is required to check his package upon receipt. Any complaint for non-compliance must be transmitted within 48 hours of the date of receipt of the order. SCOP APP is released from its delivery obligation for all fortuitous events or force majeure. Total or partial strikes, floods, fires are cases of force majeure. The transfer of ownership of the products delivered or to be delivered is suspended until full payment of the price by the customer, without affecting the transfer of risk. The goods always travel at the risk of the recipient, as soon as they have left the premises of the SCOP APP and this from the date of deposit at the Post Office (the postmark on the shipping slip is taken) ). Always check your package upon arrival. You have 48 hours to issue any reservations to the carrier in case of missing or damaged items.

X. Right of withdrawal

In accordance with the provisions of article L. 121-20 of the Consumer Code, the customer has a withdrawal period of seven working days from the day of receipt of the products ordered to return them without penalty to SPIRULINE DU SOLEIL, at the following address: 105 RN7 13670 VERQUIERES. The customer must inform SCOP APP, within the period of seven working days, of its decision to withdraw by any written means (mail, email, fax). If the seven (7) day period normally expires on a Saturday, Sunday or a public holiday, it is extended until the next working day. Only products that have been returned by the customer will be taken back at the latest within the period of fourteen days following the communication of its decision to withdraw, in their original packaging and provided that they are suitable for new marketing. The products must not have been opened or opened. In the event of exercise of the right of withdrawal, SCOP APP will reimburse you the sums paid, (minus the actual shipping costs) the return costs remaining payable by the buyer, by bank transfer or check, within a period maximum of thirty days following receipt of the returned products.

XI. Litigation

These general conditions as well as all the operations referred to therein are subject to French law. This is the case with the substantive rules as well as with the rules of form. In the event of a dispute, the customer will first contact SCOP APP to find an amicable solution. It is understood that complaints or disputes will always be received with attention, good faith being presumed both with the customer and with SCOP APP.

Otherwise, the case will be brought before the competent courts, namely the Tarascon Court, it being specified that the time limits for acting judicially are not interrupted during the period of seeking an amicable solution
